These Terms of Use (“Terms”) govern your access to and use of the Brick 'Em mobile application, game, and related services operated by BRICK'EM POKER LLC (“Brick 'Em,” “Company,” “we,” “us,” or “our”).

By downloading, creating an account for, accessing, or using Brick 'Em, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, do not use Brick 'Em.

1. Age Requirement

Brick 'Em is intended for users 13 years of age or older.

Users under 13 are not permitted to create or maintain a Brick 'Em account.

Users under 18 may be subject to additional restrictions or parental or guardian requirements under applicable law.

2. About Brick 'Em

Brick 'Em is a competitive strategy card game incorporating poker-style card combinations together with original gameplay mechanics, attacks, counterattacks, virtual chips, rewards, multiplayer competition, and other game features.

Brick 'Em is provided for entertainment purposes.

3. No Real-Money Gambling

Brick 'Em is not a real-money gambling platform.

Unless BRICK'EM POKER LLC expressly introduces a separately authorized and legally compliant feature in the future:

Players cannot wager real money through Brick 'Em.
Virtual chips cannot be redeemed for cash.
Virtual chips cannot be withdrawn from Brick 'Em.
Virtual chips do not represent money or financial assets.
Brick 'Em does not pay cash prizes based on ordinary gameplay.
Players may not use Brick 'Em to arrange unauthorized real-money wagers with other players.

Poker terminology, poker hands, chips, pots, and similar gameplay elements are used as components of the Brick 'Em game.

Players are prohibited from using Brick 'Em chat, party rooms, or other communication systems to solicit, organize, advertise, or facilitate unauthorized real-money gambling.

4. Player Accounts

Certain Brick 'Em features require an account.

You agree to provide accurate information and maintain the security of your account.

You are responsible for activity occurring through your account.

You may not:

Sell an account.
Purchase another player's account.
Transfer an account without authorization.
Access another player's account without permission.
Impersonate another person.
Create accounts for fraudulent or abusive purposes.
Use multiple accounts to manipulate games, rankings, rewards, or other players.

Immediately contact us if you believe your account has been compromised.

5. Game License

Subject to these Terms, BRICK'EM POKER LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Brick 'Em for personal entertainment.

This license does not transfer ownership of Brick 'Em or any Brick 'Em intellectual property to you.

6. Fair Play

Players must play Brick 'Em fairly.

You may not:

Cheat.
Collude with other players.
Manipulate matches.
Manipulate rankings.
Manipulate chip or token balances.
Exploit bugs or glitches.
Use unauthorized bots.
Use scripts or automated gameplay systems.
Modify the Brick 'Em application.
Use unauthorized third-party software to obtain an advantage.
Intentionally disconnect to avoid legitimate game outcomes or penalties.
Abuse matchmaking systems.
Fraudulently obtain achievements or rewards.
Interfere with Brick 'Em servers or networks.
Attempt to gain unauthorized access to Brick 'Em systems.

BRICK'EM POKER LLC may investigate suspicious activity and take appropriate action.

7. Virtual Chips and Digital Items

Brick 'Em may provide virtual chips, tokens, achievements, celebrations, emojis, cosmetics, rewards, and other digital items.

Unless expressly stated otherwise, all such items:

Exist only within Brick 'Em.
Have no cash value.
Are not legal currency.
Cannot be redeemed for money.
Cannot be exchanged through Brick 'Em for money.
Do not represent deposits or financial accounts.

Your ability to use virtual items constitutes a limited license to access those items within Brick 'Em.

BRICK'EM POKER LLC may reasonably modify virtual economies, rewards, balances, pricing, or gameplay values to maintain or improve the game.

8. Purchases

Brick 'Em may offer optional digital purchases.

Purchases made through Apple, Google, or another authorized platform may also be subject to that platform's terms and payment policies.

You agree not to engage in:

Payment fraud.
Unauthorized purchases.
Fraudulent chargebacks.
Purchase manipulation.
Exploitation of payment errors.
Unauthorized resale of Brick 'Em digital content.

9. Player Communications

Brick 'Em may offer chat, emojis, reactions, party rooms, friend systems, profile pictures, usernames, and other social features.

You agree not to use these features for:

Harassment.
Threats.
Bullying.
Hate speech.
Sexual exploitation.
Illegal content.
Fraud or scams.
Spam.
Impersonation.
Sharing another person's private information without permission.
Soliciting minors for inappropriate purposes.
Arranging unauthorized gambling.
Encouraging illegal activity.

Brick 'Em may remove content or restrict accounts when reasonably necessary to enforce these Terms and protect the community.

10. User-Generated Content

You retain applicable rights to content you submit to Brick 'Em, such as profile pictures and messages.

By submitting content, you grant BRICK'EM POKER LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, process, and otherwise use that content as reasonably necessary to operate, moderate, secure, and improve Brick 'Em.

You represent that you have the necessary rights to content you submit.

11. Reporting and Blocking

Players may report inappropriate users, communications, or content through available Brick 'Em reporting features.

Players may block other users where blocking functionality is provided.

BRICK'EM POKER LLC may investigate reports and take appropriate action.

12. Game Rules and Updates

Brick 'Em is an evolving game.

We may modify:

Gameplay rules.
Card mechanics.
Chip values.
Game modes.
Rewards.
Achievements.
Matchmaking.
Digital items.
User-interface features.
Technical systems.

Updates may be required to continue using Brick 'Em.

13. Bugs and Exploits

Players are encouraged to report technical problems.

Knowingly exploiting a bug to obtain an unfair advantage, digital items, rankings, wins, chips, or other benefits is prohibited.

Brick 'Em may correct improperly obtained balances, statistics, rewards, or achievements.

14. Account Suspension and Termination

BRICK'EM POKER LLC may warn, restrict, suspend, or terminate accounts when we reasonably determine that a player has violated these Terms, engaged in fraud or cheating, threatened users or systems, or otherwise seriously interfered with Brick 'Em.

Depending on the circumstances, enforcement may include:

Warning.
Chat restriction.
Feature restriction.
Temporary suspension.
Removal of improperly obtained items or rankings.
Permanent account termination.

15. Account Deletion

Players may request deletion of their Brick 'Em account through the account deletion feature provided within the application.

Account deletion may permanently remove game progress, statistics, rankings, achievements, virtual items, profile information, and other account-related data.

Certain records may be retained where legally required or reasonably necessary for security, fraud prevention, dispute resolution, or legal compliance.

16. Intellectual Property

Brick 'Em, its branding, logos, artwork, graphics, software, game assets, Brick Cards, original game materials, written materials, sounds, visual designs, and other protected content are owned by or licensed to BRICK'EM POKER LLC, except where otherwise indicated.

You may not copy, reproduce, distribute, sell, modify, reverse engineer, commercially exploit, or create unauthorized derivative works from protected Brick 'Em content except where permitted by law or expressly authorized by BRICK'EM POKER LLC.

17. Third-Party Services

Brick 'Em may rely on third-party services for authentication, hosting, analytics, advertising, multiplayer functionality, payments, notifications, and other functionality.

Third-party services may be governed by their own terms and privacy policies.

18. Service Availability

We work to maintain Brick 'Em but cannot guarantee uninterrupted or error-free operation.

Brick 'Em may occasionally experience maintenance, outages, server problems, bugs, network problems, updates, or circumstances outside our reasonable control.

19. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRICK 'EM AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

BRICK'EM POKER LLC DOES NOT GUARANTEE THAT THE APPLICATION WILL ALWAYS BE AVAILABLE, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRICK'EM POKER LLC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE BRICK 'EM.

Any limitation applies only to the extent permitted by applicable law.

21. Changes to These Terms

We may update these Terms as Brick 'Em evolves.

Material changes may be communicated through the application, email, or another appropriate method.

The Last Updated date indicates the latest revision.

22. Governing Law

These Terms are governed by applicable laws of the State of New Jersey and applicable federal law, without overriding consumer protections or other rights that must apply under the laws of a user's jurisdiction.
